Legal Sport Gambling States

House Bill No. 3102, introduced in 2017, reportedly amended South Carolina`s Constitution to allow “sports betting on professional sports.” All bets would have been “strictly” regulated and limited to “certain” areas. According to a court document from the New York Daily Fantasy lawsuit now settled with DraftKings and FanDuel, the current definition of gambling in South Carolina includes “betting money on the outcome of a game,” regardless of the skills associated with the game. The bill was not passed until the end of the legislature, but a new bill was introduced in early 2019. The state passed a law in early 2020 allowing sports betting at tribal casinos in the state. Sports betting is a type of game that involves predicting and betting on the outcome of physical activity. The term sports betting can include sports competitions such as basketball or American football, non-sporting events (e.g., auto racing), and non-human competitions (e.g., horse racing).

While technically not a sport in the traditional sense, some online sports betting sites also offer the opportunity to bet on non-sporting events, such as political election results and/or entertainment events (such as the Oscars). Illegal: Sports betting is illegal in Vermont, both online and in person. A bill was introduced in the state legislature in 2022, but has grown little. North Carolina allowed sports betting in July 2019, though it`s limited to two separate tribal casinos on the west side of the state. These state`s land-based casinos first received bets in March 2021. Potential laws allowing online betting could be addressed as early as fall 2022, but it`s more likely that the issue will be tabled by 2023. The interactive map below shows where betting is legal, and in places where it isn`t, it predicts when it will be. The laws expired in May of the same year after the state legislature closed early due to Covid-19. Nevertheless, the governor`s support is a huge advantage for sports betting in the Last Frontier. Total bets are bets that deal with the final outcome or the outcome above or below a betting line. On the last day of the state legislature, June 19, 2019, Maine lawmakers passed “legislation to ensure proper oversight of sports betting in the state.” Shortly thereafter, the governor vetoed the bill. Lawmakers could revive the bill with a special session or reintroduction next year. The current version allowed both retail betting and mobile betting. The bill banned betting on high school events and college competitions involving Maine schools. However, betting on “eSports” was allowed. The state legislature approved sports betting in Buckeye State in 2021, allowing the gates to open the doors to regulated sports betting on January 1, 2023. Ohio was lagging behind, but the state eventually passed an online sports betting law that will make it one of the largest markets. The California election in November will likely include two different appointments to legalize sports betting. Arkansas is relatively new to the sports betting scene as it became legal in February 2022.

Originally, sports betting was limited to just three land-based casinos, but state lawmakers imposed sweeping measures for full regulation in spring 2022. These laws allowed up to eight online sports bets to operate in the state. With New York and Canada now legal and Massachusetts heading toward legalization, Vermont will soon be surrounded by sports betting, which could eventually reach the finish line. He has seen little to no movement toward legalizing online sports betting. Illegal: Sports betting is illegal in Texas, both online and in person. Legalization does not seem likely in the near future. In 2021, a sports betting law was proposed but not legalized. The tribes, which have a significant lobbying presence in the Statehouse, have resisted for years any legislation that would not give them a monopoly on sports betting.

After the Senate amended the House bill, they withdrew their support. Legal: Kansas became the latest state to join the legal sports betting movement after introducing online and in-person betting on September 1.
