[102] For example, a court may declare a class action waiver unscrupulous if applied to a claim for a $5 late fee, while maintaining a similar waiver applied to a $100,000 breach of contract claim. [103] While the courts have concluded that there is not per se a prohibition on class action waivers,[195] class action waivers should be abolished.
